General Terms and Conditions

Last updated: October 2026

1. Scope, seller

(1) These General Terms and Conditions apply to all orders you place via our online shop at curatedattire.store. Your contractual partner is Immanuel Brown, trading as “Curated Attire”, Tittardsfeld 68, 52072 Aachen, Germany, email: info@curatedattire.store (“we” or “us”).

(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (Section 13 German Civil Code, BGB). A trader is a natural or legal person or a partnership with legal capacity acting in the exercise of their trade, business or profession (Section 14 BGB).

(3) We do not accept any deviating terms unless we have expressly agreed to them in writing.

2. Conclusion of contract

(1) The presentation of items in our online shop does not constitute a legally binding offer but an invitation to place an order.

(2) You can add items to your cart and start the checkout via the “Check out” button. There you enter your contact and delivery details and choose your shipping and payment method. Before completing your order, all details are shown to you again; you can correct input errors at any time using the edit functions or your browser's back button. By clicking the order button (e.g. “Pay now”) you submit a binding offer to purchase the items in your cart.

(3) Immediately after submitting your order, you will receive an order confirmation by email. With this order confirmation we accept your offer, and the purchase contract is concluded.

(4) Many of our items are one-of-a-kind pieces. If an ordered item should exceptionally no longer be available, we will inform you without delay and refund any payments already made immediately.

(5) The contract language is German.

(6) We store the text of the contract. We will send you your order details and these terms with the order confirmation by email. You can also access these terms on this page at any time. If you have created a customer account, you can view your orders there.

3. Prices and shipping costs

(1) All prices shown are final prices. As a small business within the meaning of Section 19 UStG, we do not charge VAT and therefore do not show it.

(2) Shipping costs are charged in addition to the prices. They are shown on our “Shipping and Payment” page and during checkout before you place your order.

4. Delivery

(1) We deliver to the countries listed on our “Shipping and Payment” page. Delivery times are also stated there or in the respective product description.

(2) If you are a consumer, the risk of accidental loss or deterioration of the goods passes to you only upon handover.

5. Payment

(1) The available payment methods are shown on our “Shipping and Payment” page and during checkout.

(2) The purchase price is due upon conclusion of the contract. For payments via third-party providers (e.g. PayPal or Klarna), their terms, which are shown to you during checkout, also apply.

6. Retention of title

The goods remain our property until full payment has been made.

7. Right of withdrawal

Consumers have a statutory right of withdrawal. Details can be found in our withdrawal policy. You can also declare your withdrawal online using the “Withdraw from contract” function.

8. Liability for defects (statutory warranty)

(1) The statutory warranty rights apply. The limitation period for warranty claims is two years from delivery of the goods.

(2) Vintage and second-hand items are used goods. Typical signs of age and wear (e.g. slight fading, pilling or traces of previous wear) as well as specific deviations (e.g. stains, small holes, cracks in the print) are described in the respective product description and shown in the product photos. For consumers, a condition that deviates from the objective requirements is only deemed agreed if you were specifically informed of it before placing your order and the deviation was expressly and separately agreed (Section 476 (1) sentence 2 BGB).

(3) If goods are delivered with obvious transport damage, please report this to the delivery driver as soon as possible and inform us. This does not affect your statutory rights; the report merely helps us to assert our own claims against the carrier.

9. Liability

(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and to the extent of any guarantee given.

(2) In the event of a slightly negligent breach of an essential contractual obligation – i.e. an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely – our liability is limited to the foreseeable damage typical for this type of contract. Otherwise, liability for slight negligence is excluded.

(3) The above limitations of liability also apply in favour of our vicarious agents.

10. Dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

11. Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive you of the protection afforded by mandatory provisions of the law of the country in which you have your habitual residence.

(2) Should individual provisions of these terms be invalid, the validity of the remaining provisions shall remain unaffected.
